If the common-sense picture of stage I is a philosophical construct, it will contain from the start certain philosophical presuppositions that pave the way for the skeptic's findings and prescribe in advance the plausibility of the stage III redescription of our epistemic predicament.

Rickert's concept of "validity" is a purely epistemological notion, as it was for Lotze before him. It is introduced to account for the ways that laws can be universally binding and is therefore supposed to be metaphysically neutral, beyond both realism and nominalism. Rickert also wants to leave the concept of the "transcendental subject" or "consciousness in general" metaphysically neutral. The subject is posited solely in order to justify the construction of cross-cultural and transhistorical values that are the a priori imperatives of thought.
